Attorney-General Petitions NJC

The office of the Attorney-General of the Federation and Minister of Justice has petitioned the National Judicial Council, NJC, on the ex parte order granted by Justice Adolphus Enebeli of the Rivers State High Court to stop the swearing-in of Victoria Nyeche, as member of the Rivers State House of Assembly.

The petition addressed to the Secretary of the NJC observed with dismay the ex parte order of injunction by Justice Enebeli on the 20th April this year in a case between Mr. Livingstone Weche and Victoria Nyeche, who is the member-elect for Port Harcourt City Constituency One.

The office of Attorney-General and Justice Minister therefore called for an investigation of the Judge for the order asking the Speaker of the House of Assembly, Mr. Adams Dabotorudima not to swear in the member-elect after her election was affirmed by the Court of Appeal.

The petition also noted that Justice Enebeli has no jurisdiction to stop the swearing of Victoria Nyeche, which amounts to dabbling into an electoral matter that only Election Tribunal is vested with the competence to determine.
